Privacy policy and Terms

This is the privacy statement of Focus JJ Amsterdam (registered in the Trade Register of the Chamber of Commerce as Flow State Martial Arts B.V. under number 82279942).

Membership forms:

 

We offer memberships that are paid monthly or yearly, in the 2 times per week or unlimited variations.

  1. Membership fees of monthly subscriptions are due before the first of each month. You may pay by direct debit, credit card or by bank transfering your membership fees. Monthly membership types are automatically renewed each month. We have a 30 day cancellation policy.

  2. Membership fees of yearly subscriptions have to be paid in advance and in full at the start of your yearly membership. This membership will automatically end after said year. Afterwards you may purchase a new yearly membership. Should you want to quit before the end of the year you've purchased, we offer no refunds.

  3. The 2 times per week subscription gives you 8 credits each month, which expire at the end of each month. If a technique class is followed by an open mat or live sparring, this counts as one class. For these classes, you only need to register for one of the two classes in the app. 

  4. The unlimited classes subscription gives you access to all regular classes (including open mats, live sparring, etc). The sole exception being kids classes if you are an adult and vice-versa.

By training at Focus JJ Amsterdam, you agree with and will adhere to the Focus JJ Amsterdam

 

Code of Conduct:

 

  1. Be respectful towards your training partners. 

  2. Act responsibly: train seriously and be mindful of your partner's weight and skill level.

  3. Always respect the tap.

  4. Most injuries happen because of unnecessary accidents, so mind the people around you when you train and/or spar.

  5. Maintain good hygiene: trim your nails, wear a clean gi and wash your gi after each class. Wear flip flops or cover your feet when walking off the mat.

  6. Enjoy your time on the mat!

 

Waiver:

 

I realize practicing any form of martial arts bears an inherent risk and may lead to injury. To the best of my knowledge, I am in good physical condition and fully able to participate in each class. I voluntarily assume full responsibility for any risks or loss, property damage or personal injury, including death, that may be sustained by me, or loss or damage to property owned by me, as a result of participation in each class or open mat.

By training at Focus JJ Amsterdam, I acknowledge that I have read the foregoing waiver of liability and I agree not to hold Focus JJ Amsterdam or any of its employees/trainers accountable for any risk or loss of property damage, injuries or death I might sustain whilst participating in each class or open mat.

We want to be transparent about the processing of your personal data by Focus JJ Amsterdam and that is why we have produced this privacy statement.

Focus JJ Amsterdam handles your personal data with the utmost care and complies with the laws and regulations relating to the protection of personal data, including the General Data Protection Regulation (GDPR).

Below we have listed which of your data we process, why we do it, and how we handle your personal data. In addition, it explains how you can change the processing of your personal data by Focus JJ Amsterdam.

Because we are a dynamic company in a rapidly developing environment, it is important that we update our privacy statement from time to time. We therefore reserve the right to change this privacy statement at any time. You can always find the most current statement on our website. We therefore advise you to visit this page regularly.

Which personal data are processed by us?


Focus JJ Amsterdam processes personal data. According to the GDPR, personal data is "any information about an identified or identifiable natural person". These are any data that can be traced directly or indirectly to you as an individual.

We receive the data directly from you, when you join Focus JJ Amsterdam, you visit the website or when you contact via social media.

Data from our members


When becoming a member of Focus JJ Amsterdam, we will as a minimum process your name, address, place of residence, telephone number and your email address, bank account number, gender and date of birth.

If you already have a Focus JJ Amsterdam membership, we will continue to process this type of personal data about you. When using Focus JJ Amsterdam services, depending on which services are purchased, the following personal data are also processed: membership number, language choice, last visit to the club, type of subscription, the information you may have given to our customer service, your financial status with Focus JJ Amsterdam (purchased services and products and whether these have been paid).

 

Website visitors' data


The personal data of visitors to our website are also processed. This concerns personal data that you enter on the contact page or the webshop itself, such as your email address, name, address, place of residence, current location or telephone number.

Social media posts
The information that you personally enter on social media or that we collect in response to your reactions to social media statements are processed by Focus JJ Amsterdam. This may include personal data that you enter on the contact page of the relevant platform, such as your email address, name, address, place of residence or telephone number.

What are the bases for processing?


We may only process your personal data if there is a legal basis for it. The following principles are:
•    when you have given permission for this. The permission can always be withdrawn again;
•    the execution of the agreement that you have entered into with Focus JJ Amsterdam;
•    compliance with a statutory obligation of Focus JJ Amsterdam;
•    to protect vital interests of you;
•    to fulfil a task of general interest or exercise of public authority; and
•    for the representation of the legitimate interests of Focus JJ Amsterdam.

What is the purpose of processing your data?

Services
Focus JJ Amsterdam processes your data to provide you with our services in providing martial arts classes. For handling and answering questions and complaints, preparing, sending and collecting invoices, and communicating in the right language. 

Notifications
Focus JJ Amsterdam processes your data in order to keep you informed, mainly by email (or, very occasionally, by letter or by telephone). You will receive information about your subscription: you are not able to unsubscribe from these messages. You will also receive information about similar products and services from Focus JJ Amsterdam, such as confirmation of training schedules and new group lessons. You can unsubscribe from these messages at any time.

Marketing and sales activities
When you register you will also be asked if you want to receive information about other Focus JJ Amsterdam products and services. If you indicate that you would prefer not receive this type of information, you will not receive this information. You can unsubscribe from this information at any time. To clarify: we do not sell the personal data of our members to third parties for their direct marketing activities.

Analysis & (market) research
We may use your personal data for research and analysis, with the aim of improving Focus JJ Amsterdam services and those of its affiliates. We may also ask you if you would like to participate in a no-obligation customer or market research survey in order to improve our services. You decide whether you want to participate in this by giving/not giving your consent.

Reports
Focus JJ Amsterdam processes member data for statistical analysis and management reports. Decisions are made on the basis of these analyses and reports, products and services are evaluated, and campaigns are assessed to see whether they are effective. Members' data is used for this purpose at an aggregated level. Aggregated means that the data does not contain information about individual members, but only contains information about specific groups based on usage, age or new membership.

Contact with member
If you contact us or we contact you by phone, email, social media, chat or in any other way, your data will be recorded. This allows Focus JJ Amsterdam employees to see at a later point that you have been in touch and what you got in contact about. This will help us deal with your enquiry more quickly and effectively. This could include enquiries about services, complaints, invoices or payments if you participate in market research and sales discussions. 

Legal obligations
Focus JJ Amsterdam may be required under the law or regulations to process your personal data and/or provide it to third parties. For example, if a competent authority such as the police requests this in the context of a criminal investigation.

Other purposes
If Focus JJ Amsterdam wants to use personal data for a purpose other than that already described, it will ask you for permission. 

Do we use cookies?


Focus JJ Amsterdam uses cookies when offering its services. We use cookies to personalise content, to provide social media features and to analyse our traffic. We also share information about your use of our site with our social media, advertising and analytics partners who may combine it with other information that you’ve provided to them or that they’ve collected from your use of their services. You consent to our cookies if you continue to use our website.

How do we safeguard your data?


Focus JJ Amsterdam has appropriate technical and organizational security measures in place to protect personal data against loss, destruction or damage, unauthorized access, or any other form of unlawful processing of your personal data. We do this by having in place physical and organizational measures for access security, protecting all desktops with user name, password, and authorization management. But also by keeping software up-to-date and regularly testing our security systems.

How long do we keep your data?


We will retain your data so long as is necessary for the purposes for which we process your data and for no longer than legally permitted. The actual retention period will differ depending on the type of personal data. If you have a Focus JJ Amsterdam membership, we will keep your details for at least the term of your membership. Once the retention period has come to an end, your personal data will be anonymized or deleted. 

Do we use third-party services when processing data?


Focus JJ Amsterdam uses the services of other parties. This only happens after screening in relation to security and privacy and only after the company has signed an agreement with respect to the use and protection of personal data. Actions involving third parties include: offering introductory classes, (online) marketing, market research, debt collection, advertising and analysing the effectiveness of advertisements, web analysis and applications/SaaS services used in the context of recruitment and selection, membership administration, customer service and marketing, telephone contacts and banking transactions.

Do we provide information to third parties?


In principle, Focus JJ Amsterdam does not provide or sell data to third parties. Focus JJ Amsterdam may be required under the law or regulations to process your personal data and/or provide it to third parties. For example, if a competent authority such as the police requests this in the context of a criminal investigation.

What influence do I have over the processing of my personal data?


Data subjects have a number of rights under the GDPR. Everyone has the right to view, correct, or add to their personal details, to have them corrected or added to, to have them deleted, to request a restriction to process, to have them transferred, and to object to the processing of his or her personal data. Below is a brief explanation of the various rights.

Access to data
You have the right to inspect your personal data and to receive a copy of it.

Rectification of data
You have the right to have your personal data corrected if these are incorrect and have them added if they are incomplete. 

Deletion of data
You can request that your personal data be deleted and this request must be complied with in the following cases: because the data is no longer necessary for the purposes for which it was collected or processed, because you withdraw your consent because you have successfully objected to its processing, because the personal data have been processed unlawfully, or to comply with a legal obligation.

Restriction to processing
You have the right to request and be granted a restriction to processing in a number of specific cases: during the period of a dispute as to the correctness of personal data and the checking thereof, if the processing turned out to be unlawful but you do not want the data to be deleted, if Focus JJ Amsterdam does not need the data anymore but you have need the data for a legal claim, and when you object to the processing and you are awaiting a reply to the objection.

You request that your personal data be blocked (temporarily locked) with the aim of restricting processing in the future.

Portability of data
You have the right to have your data transferred. This means you can request and receive a copy of your personal data that could then be used by another service provider, for example. The data will be provided in a structured, current, and machine-readable form. This might mean an Excel file, CSV file, or otherwise downloadable format. This right only applies if the processing of the data is based on consent or an agreement and if the processing is carried out via automated procedures. 

Objections to processing
You have the right at all times, on the grounds of reasons relating to your specific situation, to object to: the processing of your personal data on the grounds of a general public service or a service assigned to Focus JJ Amsterdam in the context of exercising official authority and if the processing is necessary for the protection of the legitimate interests of Focus JJ Amsterdam or a third party, when your interests weigh more heavily. 

If your personal data are processed for direct marketing, you may also object to this processing at any time as well as to any profiling that relates to direct marketing.

File a complaint
You have the right to file a complaint about how we handle your data. When you have a complaint, we prefer to solve it directly with you. In addition, you always have the right to contact the competent authority that supervises the protection of personal data with your complaint.
